Terms & Conditions
What Are These Terms. & Why Do They Matter?
These Terms & Conditions ("Terms") are the legal agreement between you — our customer — and MariVal Jewelry NYC ("MariVal," "we," "us"). Think of them as the ground rules for any purchase you make with us.
Every jewelry business is required to have Terms & Conditions on their website. They protect both you and us: they tell you exactly what to expect when you place an order, what our responsibilities are if something goes wrong, and what the limits of those responsibilities are. They also protect us from chargebacks, disputes, or claims that fall outside what we promised.
By placing an order with MariVal Jewelry NYC — whether through our website, by direct message, or through any other channel — you are agreeing to these Terms. Please read them. They are written to be clear and fair.
1. Placing an Order
When you place an order through our website or directly with us, you are making an offer to purchase the item(s) described. Your order is confirmed when you receive a written confirmation from MariVal. We reserve the right to decline or cancel any order at our discretion; if we do, we will refund any payment received.
All orders — including custom and made-to-order pieces — are subject to these Terms. For custom orders, a non-refundable deposit is required before work begins (see Section 11 below).
All sales are final, except as expressly stated in these Terms.
2. Pricing, Taxes & Fees
All prices are listed in U.S. dollars (USD) and do not include shipping, handling, applicable taxes, or other charges, unless expressly stated otherwise. MariVal reserves the right to update pricing at any time; however, the price shown at the time you place your order is the price you will be charged.
MariVal may be required by law to collect sales tax depending on your shipping address. If applicable, tax will be calculated and shown at checkout. You are responsible for any import duties, customs fees, or local taxes that may apply to international orders.
3. Payment
Payment is due in full at the time of purchase, unless a deposit arrangement has been agreed upon in writing. We accept all major credit cards and other payment methods listed at checkout.
For custom orders, a deposit schedule will be outlined in your order agreement. Remaining balances must be paid before the piece is shipped or delivered.
4. Shipping & Delivery
All shipments are made through third-party carriers. Title to — and risk of loss of — your order passes to you the moment we hand it off to the shipping carrier. Once your order is in the carrier's hands, MariVal is not responsible for delays, loss, theft, or damage that occurs during transit.
If your package is lost or damaged in transit, you must file a claim directly with the shipping carrier. We will assist you with documentation wherever possible, but the claim must be made with the carrier.
Estimated delivery times are not guaranteed. MariVal is not liable for carrier delays or circumstances beyond our control.
5. Pre-Shipment Inspection, Returns & Defective Items
Quality Before It Leaves Us. Every piece is inspected by MariVal before it is shipped. We verify that your order matches your specifications and that the item is in perfect condition prior to dispatch. A shipping confirmation will be sent once your order has passed inspection and been handed to the carrier.
Return Eligibility. We offer returns for a full refund or exchange within fourteen (14) days of receipt for in-stock items. To be eligible, items must be returned unworn, unaltered, free of any damage, and in their original condition with all original packaging materials included. Returns that arrive without original packaging, show signs of wear, or have been altered in any way will not be accepted.
Final Sale Items. The following items are final sale and not eligible for return or exchange under any circumstances: made-to-order pieces, custom-designed pieces, items that have been engraved, and items that have been resized. By placing an order for any of these items, you acknowledge and agree that the sale is final.
How to Initiate a Return. All returns require prior written authorization from MariVal before shipping anything back to us. To request a return, email us within the fourteen (14) day window with your order details. If your return is approved, we will provide specific shipping instructions. Items sent back without authorization will not be processed.
Damaged or Defective Items. If your item arrives damaged or does not match your order, contact us within fourteen (14) days of delivery with a detailed written description and clear photographs of the item and its packaging. We will review your claim and, at our sole discretion, repair the item, replace it, or issue a refund for the affected portion of your order. This is your exclusive remedy for damaged or defective goods. If you do not notify us within fourteen (14) days of delivery, you will be deemed to have accepted the item as delivered. MariVal will not reimburse any labor costs or expenses incurred from attempting to repair an item independently.
6. Jewelry Care & Normal Wear
Fine jewelry is made to be worn every day — but it does require care. Prongs and settings wear down over time, and gemstones may loosen or fall out without regular maintenance. MariVal is not responsible for the loss of any gemstone after delivery unless the loss is caused by a proven material defect in the piece.
We strongly recommend having your jewelry professionally inspected once a year, and avoiding exposure to harsh chemicals, extreme temperatures, and heavy impact.
7. Limited Warranty
MariVal warrants that each piece will reasonably conform to the materials and attributes described in your order documentation. If a piece contains a Material Defect — defined as a substantial deviation from what was specified — we will, at our cost, repair or replace the affected piece.
A "Material Defect" does not include: (a) normal wear and tear; (b) damage caused by improper care, accidents, or unauthorized repair; or (c) variations in gemstone grading where MariVal has reasonably relied on third-party certifications (such as GIA certificates). For example: if your order specifies platinum and the piece was made in white gold by mistake, that is a Material Defect. If a GIA-certified diamond is later found to have a grading discrepancy, that is not.
THIS LIMITED WARRANTY IS VOID IF YOU: (I) ATTEMPT TO MODIFY, ALTER, OR REPAIR THE PIECE WITHOUT OUR EXPRESS PRIOR WRITTEN CONSENT; (II) REPLACE ANY COMPONENT WITHOUT OUR PRIOR WRITTEN AUTHORIZATION; OR (III) FAIL TO REASONABLY COOPERATE WITH US IN A WARRANTY CLAIM, INCLUDING REFUSING TO PROVIDE PHOTOGRAPHS OR RETURN THE ITEM FOR INSPECTION.
MariVal has no liability for any claim related to the fluctuation, decline, or perceived change in the market value of any diamond, gemstone, or jewelry product.
8. Diamonds, Gemstones & Market Value
Some pieces sold by MariVal may contain lab-grown (lab-created) diamonds, natural diamonds, or other gemstones. Lab-grown diamonds are man-made products created to replicate the conditions of natural diamond formation. The markets for diamonds and gemstones evolve over time and may experience fluctuations in supply, demand, and pricing.
MariVal makes no representation, warranty, or guarantee about the current or future market value, resale value, or investment potential of any diamonds or gemstones purchased from us. All jewelry is purchased as a luxury consumer good — not a financial investment. By purchasing from MariVal, you expressly waive any claim against us relating to the present or future value of any item.
9. Disclaimer of Warranties
Except for the Limited Warranty in Section 7, all goods are sold "AS IS." MariVal expressly disclaims all other warranties — written, oral, implied, or statutory — including but not limited to warranties of merchantability and fitness for a particular purpose, and any warranties arising from trade usage or course of dealing.
Descriptions, images, and samples shown on our website or in marketing materials are for identification purposes only and do not constitute additional warranties. No employee, agent, or representative of MariVal is authorized to make any warranty beyond what is expressly stated in these Terms.
10. Limitation of Liability
To the fullest extent permitted by law, MariVal is not liable for any indirect, incidental, punitive, special, or consequential damages of any kind arising from or in connection with your purchase — even if we have been advised of the possibility of such damages.
If liability cannot be fully excluded under applicable law, MariVal's total liability for any claim arising from a specific order shall not exceed the amount you actually paid for that order.
No legal action against MariVal for breach of these Terms may be brought more than one (1) year after the cause of action first arises.
11. Non-Refundable Deposits
Any deposit paid to MariVal is wholly non-refundable for any reason. By paying a deposit, you acknowledge that: (i) MariVal has agreed to your order in reliance on the non-refundable nature of the deposit; (ii) it would be impractical to estimate the damages MariVal would suffer if an order is cancelled; and (iii) the deposit represents a reasonable estimate of our losses in the event of cancellation. This applies regardless of reason, including personal or relationship-related circumstances (see Section 12).
12. Personal Circumstances
We understand that jewelry — especially engagement rings, wedding bands, and sentimental pieces — is tied to meaningful life moments. However, changes in personal circumstances — including but not limited to cancellation of an engagement, change in relationship status, divorce, change of preference, or financial hardship — do not constitute grounds for cancellation, return, or chargeback of any order.
Many of our pieces are custom-designed or specially manufactured for you. All payments — deposits and final balances — are non-refundable once work has begun. MariVal has no obligation to repurchase, refund, or exchange goods based on personal circumstances.
13. Chargebacks & Payment Disputes
All payments made to MariVal are authorized and final, subject only to the remedies stated in these Terms. Before initiating any chargeback, payment reversal, or dispute with your bank or card issuer, you agree to contact MariVal directly and make a good-faith effort to resolve the issue with us first.
If you initiate a chargeback in violation of these Terms, you agree that MariVal may submit your order documentation, invoices, design approvals, shipping confirmations, and these Terms to the payment processor as evidence of your authorization. Any wrongful chargeback constitutes a material breach of these Terms, and MariVal is entitled to recover the reversed amount, processing fees, reasonable attorney's fees, collection costs, and any other damages permitted by law.
14. Force Majeure
MariVal's performance obligations are suspended if we are prevented by causes beyond our reasonable control, including but not limited to: accidents, labor disputes, natural disasters, fires, floods, war, acts of terrorism, civil unrest, government orders, supplier failures, shipping disruptions, customs delays, or other acts of God. We will make commercially reasonable efforts to notify you and resume performance as soon as possible.
15. Governing Law & Jurisdiction
These Terms are governed by the laws of the State of New York, without regard to conflict of law principles. Any dispute arising from or relating to these Terms or any order shall be brought exclusively in the courts of New York County, New York (state or federal). You consent to personal jurisdiction in those courts.
If any provision of these Terms is found to be invalid or unenforceable, it will be limited to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
16. General
These Terms, together with your order confirmation and any applicable invoice, constitute the entire agreement between you and MariVal. No oral promises, prior understandings, or additional terms are binding unless agreed in writing and signed by an authorized representative of MariVal.
MariVal's failure to enforce any provision in any instance is not a waiver of that provision going forward. These Terms apply to all orders regardless of where the order is placed, where delivery occurs, or your location.
